1. Acceptance of terms

By accessing or using the Go N' Fill Platform, you agree to comply with and be bound by these Terms of Service.

These Terms constitute a legally binding agreement between you (Customer, you or your) and Go N' Fill (Go N' Fill, we, us or our).

Your continued use of the Platform following any amendment to these Terms constitutes your acceptance of the revised Terms.

Our Privacy Policy forms part of these Terms and governs the collection, use, storage and protection of your personal information.

2. Eligibility

To use Go N' Fill services, you must:

Be at least 18 years of age, or use the service under the supervision and responsibility of a parent or legal guardian where permitted by applicable law.

Provide accurate and complete information when creating an account or placing an order.

Have the legal capacity to enter into a binding agreement.

Comply with all applicable laws and regulations governing the purchase, possession, transportation, storage and use of petroleum products and related services.

By using the Platform, you confirm that you satisfy these requirements.

3. Account registration

Certain features of the Platform may require you to create an account. When registering, you agree to:

Provide accurate, current and complete information.

Keep your account and contact information up to date.

Maintain the confidentiality of your login credentials and OTPs.

Not share your account credentials or authentication codes with unauthorized persons.

Notify us promptly if you suspect unauthorized access to your account.

Accept responsibility for activities carried out through your account where such activities result from your failure to protect your account credentials.

Go N' Fill reserves the right to suspend or terminate accounts where we reasonably believe that the account has been used fraudulently, unlawfully or in violation of these Terms.

4. Our services

Go N' Fill provides fuel delivery and related services through the Platform. Our services may include the delivery of petroleum products such as:

PMS (Premium Motor Spirit)

AGO (Automotive Gas Oil)

CNG (Compressed Natural Gas)

LPG (Liquefied Petroleum Gas)

Other products or services that may be introduced from time to time.

The availability of particular products, quantities, delivery locations and delivery times may vary depending on stock availability, operational capacity, location, traffic conditions, weather, regulatory requirements and other circumstances beyond our reasonable control.

Go N' Fill reserves the right to modify, suspend or discontinue any service, product or feature at any time.

5.1 Placing orders

When you place an order through the Platform, you are making a request to purchase the selected product or service at the applicable price and under these Terms. An order is not considered finally accepted until Go N' Fill confirms the order.

We reserve the right to accept, reject, modify or cancel an order where:

The requested product is unavailable.

The requested quantity cannot be fulfilled.

The delivery location cannot be serviced.

There is an error in the product description or displayed price.

We identify suspected fraudulent or unauthorized activity.

Operational, regulatory, safety, traffic or other circumstances prevent fulfillment.

Where an order is cancelled by Go N' Fill after payment has been received, any applicable refund will be processed in accordance with our refund procedures and applicable payment-provider timelines.

5.2 Pricing

All prices displayed on the Platform are subject to change without prior notice.

The price applicable to an order may be affected by factors including supplier pricing, market conditions, taxes, transportation costs, regulatory charges, operational costs and other applicable charges.

Prices displayed on the Platform are not guaranteed until the order is confirmed and fulfilled.

Where the actual applicable price at the time of fulfillment differs from the price displayed or initially communicated, Go N' Fill may cancel the order, or notify the Customer of the applicable price difference and issue a price variance invoice for the additional amount, where applicable.

The Customer will be responsible for paying any valid price variance applicable to the fulfilled order. Where an order is cancelled due to a price difference, any amount already paid by the Customer will be handled in accordance with Go N' Fill's applicable refund process.

5.3 Payment

We may accept payments through available payment methods displayed on the Platform, which may include:

Debit or credit cards

Bank transfers

Payment gateways

Other electronic payment methods supported by Go N' Fill.

You authorize Go N' Fill and its authorized payment service providers to process payments associated with your orders. All transactions are subject to verification and authorization by the relevant financial institution or payment provider.

Go N' Fill is not responsible for delays, failures, reversals or additional charges imposed by banks, payment processors, telecommunications providers or other third-party payment services.

5.4 Order cancellation by customer

Customers may request cancellation of an order before fulfillment or dispatch, subject to the applicable status of the order.

Once an order has been dispatched, delivered or otherwise committed for fulfillment, cancellation may not be permitted or may be subject to applicable charges.

Where a refund is applicable, the refund amount and processing time may depend on the payment method, order status and applicable refund policy.

6. Delivery policy

Go N' Fill aims to provide convenient and timely fuel delivery services. Where the Platform displays an estimated delivery time of 45 minutes, this is an estimated delivery timeframe and not a guaranteed delivery time.

45-minute deliveries are subject to product stock availability and traffic conditions on the roads and streets affecting the delivery route. Delivery times may also be affected by:

Traffic congestion

Road closures or restrictions

Weather conditions

Vehicle or rider availability

Security or access restrictions

Customer availability at the delivery location

Product availability

Unforeseen operational circumstances

Other circumstances beyond Go N' Fill's reasonable control.

Go N' Fill will make reasonable efforts to deliver orders within the estimated timeframe but shall not be liable for delays caused by circumstances beyond its reasonable control.

The Customer is responsible for ensuring that the delivery location is accurate, accessible, safe and suitable for the delivery of the ordered product, and may be required to provide suitable access and cooperate with reasonable delivery and safety procedures.

If the Customer or an authorized recipient is unavailable to receive the order, additional delivery attempts or charges may apply.

7. Prohibited uses

You agree not to use the Platform or Go N' Fill services:

For any unlawful, fraudulent or unauthorized purpose.

To provide false, misleading or fraudulent information.

To place orders using stolen, unauthorized or fraudulent payment methods.

To interfere with or attempt to compromise the security of the Platform.

To gain unauthorized access to another user's account.

To introduce malicious code, viruses, malware or other harmful software.

To attempt to disrupt, damage, reverse engineer or interfere with the Platform.

To use automated systems, bots, scrapers or similar tools without our prior written authorization.

In any manner that violates applicable laws or regulations.

In any manner that may endanger Go N' Fill personnel, delivery personnel, customers or third parties.

Go N' Fill reserves the right to investigate suspected violations and take appropriate action, including suspension or termination of accounts and cancellation of orders.

8. Intellectual property

All content available through the Platform, including logos, brand names, text, images, graphics, designs, software, user interface elements, product information, videos, icons and other materials, is owned by or licensed to Go N' Fill and is protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, publish, transmit, sell, license, create derivative works from or otherwise exploit any Go N' Fill content without our prior written authorization.

Nothing in these Terms grants you ownership of any Go N' Fill intellectual property.

9. User content

If you submit, upload, publish or otherwise provide content through the Platform, including reviews, feedback, comments, photographs or other materials (User Content), you remain responsible for that content. You represent and warrant that:

You have the necessary rights to submit the content.

The content does not infringe the rights of any third party.

The content is not unlawful, defamatory, misleading, abusive or fraudulent.

The content does not contain malicious software or harmful code.

By submitting User Content, you grant Go N' Fill a non-exclusive, royalty-free, worldwide license to use, reproduce, display and distribute that content for legitimate business and service-related purposes, subject to applicable law and our Privacy Policy.

10. Disclaimers and warranties

To the extent permitted by applicable law, the Platform and its services are provided on an “as is” and “as available” basis. While Go N' Fill makes reasonable efforts to maintain accurate and reliable information, we do not warrant that:

The Platform will always be available or uninterrupted.

All information will always be accurate, complete or current.

Products or services will always be available.

Orders will always be fulfilled within an estimated delivery timeframe.

The Platform will be completely free from errors, interruptions or technical issues.

Nothing in these Terms excludes or limits any rights or protections that cannot lawfully be excluded or limited under applicable law.

11. Limitation of liability

To the maximum extent permitted by applicable law, Go N' Fill shall not be liable for indirect, incidental, special, consequential or punitive losses arising from or relating to your use of the Platform or our services. This includes, where legally permissible, loss of profits, revenue, business opportunities, data, goodwill or anticipated savings.

Go N' Fill shall not be responsible for delays, failures or interruptions caused by circumstances beyond our reasonable control, including traffic, weather, road restrictions, security incidents, telecommunications failures, payment-provider failures, government actions, regulatory requirements, supplier disruptions or other force majeure events.

Nothing in this section limits liability that cannot legally be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Go N' Fill, its directors, officers, employees, agents, contractors, partners and service providers from claims, losses, liabilities, damages, costs and expenses arising from:

Your violation of these Terms.

Your misuse of the Platform.

Your violation of applicable laws or regulations.

Your fraudulent or unauthorized activities.

Your infringement of third-party rights.

Your User Content.

Your negligent or unlawful conduct.

This obligation applies to the extent permitted by applicable law.

13. Termination

Go N' Fill may suspend or terminate your access to the Platform or services where we reasonably believe that you have:

Violated these Terms.

Engaged in fraudulent or unlawful activity.

Misused the Platform.

Provided false or misleading information.

Created a security or operational risk.

Engaged in conduct that may harm Go N' Fill, its customers, employees, delivery personnel or third parties.

You may stop using the Platform at any time. Termination does not affect rights or obligations that arose before termination or provisions that are intended to survive termination.

14. Governing law and disputes

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.

The parties shall make reasonable efforts to resolve any dispute arising from these Terms or the use of Go N' Fill services through good-faith discussions.

Where a dispute cannot be resolved amicably, it may be referred to the appropriate courts or dispute-resolution mechanism having jurisdiction in accordance with applicable Nigerian law.

15. Changes to terms

Go N' Fill reserves the right to modify or update these Terms from time to time. Where appropriate, we may notify users of material changes through the Platform, email, mobile application notifications or other reasonable means.

The updated Terms will become effective from the date specified in the updated version. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

We recommend reviewing these Terms periodically to remain informed about your rights and obligations.
